About Succession Certificate

A Succession Certificate is a document that is granted by a civil court to the legal heirs of a deceased who dies without leaving a will. It is granted by the court to realize the debts and securities of the deceased. A Succession certificate is issued by the government, usually to establish a relationship for claims relating to Insurance, pension, retirement benefits or service benefits of central and state government departments, Government undertakings etc.

In legal succession cases sine qua non to obtain a succession certificate is to establish the relationship. A petition in the prescribed format must be made to the competent Civil Court—within whose jurisdiction the asset of the deceased is situated—by the legal heir claiming the asset. The petition should contain names of all heirs; details about time, date and place of death should be mentioned in the application. A copy of the death certificate has to be produced.

Once the petition is received, the court issues a notice in the newspapers along with notice to all the respondents. The notice calls for objections, if any, to issue succession certificate, and provides a period of 45 days to do the same along with necessary documentary proofs.

  • Self Attested copy of Address Proof in the name of director (Any utility bill i.e., mobile bill/water bill/ electricity bill, or bank statement which should not be older than two months)
  • Passport-sized photograph
  • Rent Agreement (Notarised: For rented property)
  • Sale Deed/Property Deed in English (in case of owned property)
  • No-objection Certificate from property owner
  • Latest Electricity Bill / Mobile or Telephone Bill / Latest Bank Statement/Gas Bill
