About Power of Attorney

Power of Attorney is a written authorization executed by one or more people, granting authority to one or more persons to act on his or her behalf through a legal document. The person giving authority to the other to act is known as a principal, grantor, or donor. Power of Attorney is governed by the Powers of Attorney Act, 1888. Normally, there is no requirement for registration of Power-of-Attorney. However, if the Power of Attorney creates interest in any immovable property, then the Power of Attorney must be registered. 

There are two types of Power of Attorney. A general power of attorney acts on behalf of the principal in any and all matters, as allowed by the state. The agent under a general POA agreement may be authorized to take care of issues such as signing checks, selling property and assets.
A limited power of attorney gives the agent the power to act on behalf of the principal in specific matters or events, or be limited to a specific period of time.

Power of Attorney can be authenticated before a Registrar or Sub-Registrar within whose district or sub-district the principal resides. In case a Power of Attorney is executed outside of India, it can be authenticated by a Notary Public or any Court, Judge, Magistrate or a representative of the Central Government.

  • Self Attested copy of any one of the Identity Proof(Voter's ID/Passport/Driver's License)
  • Self Attested copy of Address Proof in the name of director (Any utility bill i.e., mobile bill/water bill/ electricity bill, or bank statement which should not be older than two months)
  • Passport-sized photograph
  • Rent Agreement (Notarised: For rented property)
  • Sale Deed/Property Deed in English (in case of owned property)
  • No-objection Certificate from property owner
  • Latest Electricity Bill / Mobile or Telephone Bill / Latest Bank Statement/Gas Bill
