About Arbitration And Mediation

Arbitration is a form of Alternate Dispute Resolution (ADR). The Indian law of arbitration is contained in the Arbitration and Conciliation Act 1996 (Act). The subject matter of arbitration is any commercial matter including an action in tort if it arises out of or relates to a contract. Generally, matters covered by statutory reliefs through statutory tribunals would be non-arbitrable.

The arbitration agreement shall be deemed to be independent of the contract containing the arbitration clause, and invalidity of the contract shall not render the arbitration agreement void. Hence, the arbitrators shall have jurisdiction even if the contract in which the arbitration agreement is contained is vitiated by fraud and/or any other legal infirmity. 

Mediation is another form of ADR that aims to assist two (or more) disputants in reaching an agreement. The parties themselves determine the conditions of any settlements reached— rather than accepting something imposed by a third party. The disputes may involve (as parties) states, organizations, communities, individuals or other representatives with a vested interest in the outcome. 

Mediators use appropriate techniques and/or skills to open and/or improve dialogue between disputants, aiming to help the parties reach an agreement (with concrete effects) on the disputed matter. Normally, all parties must view the mediator as impartial.
