About Sale Deed

A sale deed is a legal instrument which is executed between the seller and the purchaser which evidences the sale and transfer of ownership of immovable property.  The ‘parties to sale deed’ clause must contain the description of the parties to the sale deed.

It must mention the details of the buyer and seller such as their name, address, age, contact details, occupation and the date of execution of the deed. If one of the parties wishes to execute the deal in his absence by conferring a Power of Attorney, then those details should be recorded too. There is a separate clause for the details of the property. In addition to this clause, a schedule is attached to the deed which describes these precise details.

A graphical representation of the same may be added for the convenience of the parties. The payment can be made in cash, cheque, demand draft or transfer of funds using internet banking, as per the wishes of the parties. The same payment method should be mentioned in the sale deed in this clause along with the amount of payment. In India, the use of cash for any kind of buying and selling is rampant.

At the same time, it is hard to trace and keep and produce records of cash transactions. Hence, it is advisable for both the parties to select the payment method wisely whilst keeping in mind the same.

  • Self Attested copy of any one of the Identity Proof(Voter's ID/Passport/Driver's License)
  • Self Attested copy of Address Proof in the name of director (Any utility bill i.e., mobile bill/water bill/ electricity bill, or bank statement which should not be older than two months)
  • Passport-sized photograph
  • Rent Agreement (Notarised: For rented property)
  • Sale Deed/Property Deed in English (in case of owned property)
  • No-objection Certificate from property owner
  • Latest Electricity Bill / Mobile or Telephone Bill / Latest Bank Statement/Gas Bill
